The biggest factor in determining fault in an accident is finding out who had the right of way. Finding the right of way for the section of road you were on can be fairly simple. Consider if you were at an intersection and if there was a stop light or a stop sign.
T-bone accidents commonly occur at intersections where someone was neglecting to stop at a red light. It’s important to note, though, that either party can be at fault in a T-bone accident, not just the driver who was hit. If you are hit at an intersection because you neglected to stop for a red light, you can be marked as at fault for the accident.
However, if you’re driving through an intersection and someone drives right through the red light and you hit them, they can be marked as at fault. Since you have the green light, you have the right of way.

For example, someone may have the right of way at an intersection, but they may be doing something that pulls their attention from the road. In this case, while they had the right of way, they are also at fault for being negligent.
Usually in cases of negligence both parties can be marked as at fault. That’s because there’s usually one party that has the right of way and one that doesn’t. If the party with right of way simply isn’t paying attention, they can be considered at fault as well. Thus, both parties caused the accident and no singular source of fault can be determined.
